What Happened

In July 2017, the Nevada Attorney General's Medicaid Fraud Control Unit (MFCU) opened an investigation into two behavioral health companies — Top Notch Behavioral Health and Shepherds Heart Services — for billing Nevada Medicaid for services that were never actually provided to patients.

What investigators found was a network of people connected through a church run by Gregory and Carol Kirby. The group set up multiple fraudulent companies that billed Medicaid as if mental health practitioners were seeing patients and providing therapy. In reality, many of the practitioners listed on the claims never worked for the companies. Some claims showed a single practitioner providing more than 24 hours of services in a single day — a physical impossibility.

After years of investigation and prosecution, all 11 individuals were convicted. The court ordered approximately $5.5 million in restitution to be repaid to Medicaid — money that was supposed to help Nevada's most vulnerable residents get mental health care.
